Legal Question in Family Law in South Carolina

laws against leaving state

I am currently considering leaving my husband. When I leave I am going to another state, is it against the law to take the child out of state before the divorce is over.

It is not against the law, but the Court will consider that factor when determining which parent should have custody of the child. Most times, the preference is to keep the child in SC until the case is concluded.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
