Legal Question in Family Law in South Carolina

I left my husband 7 weeks ago and took my 2 children with me. I plan on getting a lawyer and trying to get him on Adultry. I had a PI following him but I kinda blew it before I was certain that I have enough on him. I overheard a very graphic phone conversation between him and another police officer that he works with. My PI did get them going out for dinner and then going back to his office that is not part of the police departments building and is very private for over 30mins. I went down and confronted both of them that night. He is trying to fight me for full custody of my 2 children which I'm not really worried about because he cant prove Im an unfit mother because Im not. But he told me that he will be getting me for abandonment. How is this possible? I had reason to leave, does this still count as abandonment?
