Legal Question in Family Law in South Carolina

Legal father

When a married woman has an affair and has a child, who is legally the father? The husband or the boyfriend? I need to know the laws regarding this for SC.

Re: Legal father

The husband is legally presumed to be the father until the Family Court finds otherwise. Generally when this happens, the paramour (lover) is joined as a party to the divorce action and the paternity of the child is addressed at that time.

These cases are somewhat tricky, as it is therefore important that they be handled correctly. You should be sure to consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
