Legal Question in Family Law in South Carolina

Legal jurisdiction?

I am a non-custodial parent. The custodial parent of my daughter has married a man in the military. They move every two years or so. My visitation and child support was established in Tennessee. Since then, she has moved to Florida and now in South Carolina (14 months). I am seeking to file for change of custody and/or modification of visitations for which I know would justify such actions. I know that I will need an attorney. I would like to know where do I have to file the proper documentations?

Re: Legal jurisdiction?

If she has been in SC for over six months, then jurisdiction will most likely lie in SC for purposes of a custody/visitation case. However, there are some exceptions and special situations that would need to be addressed before letting you know that conclusively.

Custody cases are complex, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
