Unless parental rights have been terminated, natural parents always have the right to seek custody of their children. That is not to say that they will get custody. In normal situations, the natural parent is the preferred custodian of the child. I do not know the particular circumstances of your case and cannot advise you on courses of action which is best left to the advice of an attorney in a "one-on-one" interview where he can ask questions to get the full set of facts.
