Legal Question in Family Law in South Carolina

Legal Separation

I have been legally separated for 4 months. I would like to start dating again. Am I allowed to without any fear of being sued for adultery? I can't afford to lose my house.

Re: Legal Separation

If you are truly "legally separated" (i.e., you have been issued a Decree of Separate Maintenance), then none of the financial issues addressed in that Order will be changed by any adultery at this point. If you are only physically separated, then any adultery at this point will probably have an effect on how the financial issues in your case.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
