Legal Question in Family Law in South Carolina
I live in SC. I've lived in my house for over 20 years. I've been remarried for almost 8yrs. My husband and I have been having problems for 7 yrs of our marriage. I've tried to seek help for us, but I'm not in this marriage myself. It will take both of us and he's not willing. I have Fibromyalgia, Scoliosis, PAD, Arthritis, High Cholesterol, Migraines, Sleep Apnea (on CPAP machine), and degenerative joint disease. I told my husband that we have to get help for our marriage or we have to separate. He won't leave. He knows not to physically abuse me. But the chronic stress is killing me. We have no marrital property, no children, and no debt that we can't agree on. When we got married, he only had his clothes. Not even a car. And since we've been married, he hasn't really bought anything. How can I get him legally out of the house?

This is a very complicated question, because under some circumstances, the house could be marital property (or at least partially marital). These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.SpartanburgLawyers.com). I wish you the best of luck.
