Legal Question in Family Law in South Carolina

I live in south carolina and a young couple i know is having a baby. the couple wants to sign their baby over to me. do we have to go to court or can this be handle out of court since the mother and father both giving up their parental rights

Parents of a child can give you physical custody of the child and can give you a power-of-attorney giving certain rights to act on behalf of the child without a court order. The parents will still have legal custody of the child; you will need to petition the court for legal custody.

If the parents are consenting to an adoption and relinquishing their parental rights, you will need to follow the statutory requirements which includes both parents properly executing a consent and relinquishment and you filing a petition for adoption.
