Legal Question in Family Law in South Carolina

marriage

can you please tell me if a marriage ceromony took place on 11/24/1990 in allendale south carolina but they put the wrong date on the marriage license and certificate 11/25/1990 is it legal? Also the courthouse burned down and they have no record of the license so does that mean that it isnt valid?

Re: marriage

The scrivener's error in listing the wrong date would not make the marriage invalid. The fact that the Courthouse burned down may have lost the document itself, but there are certainly other methods of proving you were married.

Further, since S.C. still recognizes common law marriage, it will be very difficult to make a credible argument to the Court that you are not married.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.

Re: marriage

Neither a clerical error nor a fire void a marriage. You're married.
