Legal Question in Family Law in South Carolina
Married and pregnant with another mans child...
My husband and I were separated and both had relationships with other people for a short while. I got pregnant and now my husband and I are back together. The biological father of the baby is now demanding full or "split" custody of the baby. He has been incredibly cruel and even threatening at times (but not to the point where I have contacted police). At this point I just want him out of our lives for good but I'm terrified at the prospect of him getting custody or simply taking off with the baby if he gets unsupervised visitation. My husband and I already have 4 children and he is ready to raise this one as his own as well. The biological father has a criminal record and a history of heroin addiction. He has had no stable job or housing during his entire adult life (yes, I know - what was I thinking??) Will any of these things be admissable if we go to court? What are the chances of him getting full custody? (He has also suggested a six month custody split if he can't get full custody.) Will he be able to prohibit my family from moving to a different state? What kind of rights will he have?
