Legal Question in Family Law in South Carolina

Medical insurance premiums after divorce for children

I give my ex $150.00 a month towards insurance. She has a terrible plan with a $10,000 deductible which has cost us over $5000 each this past year in out of pockets. I want to put them on my plan , United Health Care, and have offered to let her keep the $150.00 to use as she wisher. She will not remove them from her plan. The order is from Texas and she now lives in So. Carolina. What should I do? I can't afford to have so many financial surprises as I already send her $1250.00 per month in child support? Thank you,

Mike

Re: Medical insurance premiums after divorce for children

There is nothing under SC law that would prohibit you from adding the additional (secondary) coverage on the children as you describe.

Further, you may benefit from seeking a recalculation of child support based on the change in insurance benefits/coverage.

Based on the amount you say you are paying her annually and monthly, you should certainly consult an experienced family law attorney to find out what options are available to you.

If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
