Legal Question in Family Law in South Carolina
mental health evaluation for minor child
My husband has custody and I have visitation on the weekends. Our 8 yr old son has been in therapy for seven months. The psychologist sees no problems. However, our son has made two suicide plans, and according to him, attempted it once. Am I within my legal limits if I have him evaluation by an independent therapist? My attorney told me that I would have to have a therapist write an affidavit recommending this.
The current psychologist called in a collegue and she recommended in-patient treatment. Our son told her that he is sad about school, daycare and the divorce. His teacher concers with this. Our son tells me is afraid of his father and will not tell him anything that may anger him. He is also afraid that the current psychologist will tell his father what he tells her.

It sound like your attorney has already answered your question. It also sounds like you wouldn't have any problem getting the affidavit that your attorney told you that you would need. I can't imagine anyone being in a better position to advise you than your attorney. Especially since there is a court order and your attorney is aware of its terms.
