Minor's Last Name Change

I gained custody of my son in November 2000, after living his entire six years of life in Iowa, with his mother. In October, she died in an accident. My son lives with me now, here in SC. Both he and I have discussed changing his last name to reflect mine and both agree to do it. I really do not want to retain an attorney for something so minute and that, if allowed, can do myself. Can I do this myself and where would I need to start? He is now seven years of age.

Although, this may seem minute to you, since it involves a child, the Court does not usually look it that way. You would need to consult an attorney in this matter. Also, a Guardian Ad Litem will probably have to be appointed to represent the child. If you know how to do all thhis, you probably will not need an attorney, but the Family Courts in our area usually don't entertain pro se actions unless the person knows what they are doing. I have seen a number of pro se petitions dismissed, and the people have lost the money they paid (Court Costs!!!).
