Legal Question in Family Law in South Carolina
minor's name change
Is is necessary for me to retain an attorney to get my minor son's surname changed in SC? If not where do I begin? must it originate from birth state?

Re: minor's name change
No, its not necessary. The law allows a person to represent themselves. However, unless you really know what your doing, you'd be far better off hiring a lawyer to do it for you. Since so many people over the years have tried to change their names to avoid criminal prosecution and creditors, the courts have made the process complicated. You now have to not only file and serve all the appropriate paperwork, but a court appearance is necessary. So although I don't blame you for trying to save some money, you'd be better off having a lawyer do it for you. As to your last question, no, you do not have to do it in the child's birth state.
