After that, I did not here from this lawyer going on 2 months now. I gave his a reason amount of time (1 month) to contact me back. However, he never did and its going 2 1/2 months now. So yesterday I wrote him a letter letting him know that I have not receive ant information from dealing with the case. Therefore, should I seek legal action or give him a little more time. All I am trying to do is return back to court to modify joint custody court order.

Since you wrote the letter "yesterday," and yesterday was a holiday, its impossible for him to have received your letter and have had time to respond. I would give him time to answer your letter.

Give him at least a week to respond to your letter. Better yet, I would simply call him and explain to him what you wrote in the letter. If you still feel that he will not represent you in a manner in which you are comfortable then simply ask for a return of the retainer or fee that has not been earned and then find another attorney. Good luck.
