Legal Question in Family Law in South Carolina

Mother could't handle son

I have been divorced for 7 yrs. and have two kids. My ex and oldest son (15) couldn't get alone. One night she brings him to my house and drops him off. Telling me she can't handle him any longer. My child support that she receives from me goes onto a bank card. She left the card with me. Is there anything I can do to get sole custody of him, and get my child support changed? I also feel that the way she just dropped him off leaving me unprepared she should pay court and attorneys fees. Is there anything I can do?

Re: Mother could't handle son

You can (and probably should) bring an action for custody of the child. At that time, the Court can (and will) address the child support issue and determine what visitation, if any, the mother should have with the child.

The issue of attorney's fees is based on a great many factors, so it's impossible to comment one way or the other on that issue without knowing much more information.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
