Legal Question in Family Law in South Carolina

the mother of i hve never been married, i live in florida she lives in south carolina. our son has lived with me and attended school as well as with her. the maternal grandparents and i feel he is in jeopardy living with his mother and i want to get him when he visits the grandparents. can i legally go get my son and bring him back to florida. there arent any custody orders in place.

If the mother and child reside in SC, then it's not as simple as you coming to get the child, because in SC unmarried mothers have sole custody until the Court says otherwise. If you came and got the child, you could find yourself charged with kidnapping. Other states may have different laws though.
