what right do he have
The mother of my son baby is in the hospital who have the right to take care of the baby while she in the hospital her mother or him?

Both parents have rights to the child. If he wants to but she doesn't want him to, then it's a stalemate. I would hate to think that these parents are already fighting over this child if it was just born.
