Legal Question in Family Law in South Carolina

Can I move?

I live in SC and I want to move 3hrs away to AL w/ my family. Me and my ex boyfriend have a 9 yr old who has always resided w/ me. I am primary custodial parent and he moved 2 yrs ago an hour away. Is there any way he can stop me from moving out of state? Is there anything important I should know before considering this move? Also when considering child support, how much of the mothers income is considered when I have 2 other children? Thank you!

Re: Can I move?

The Court cannot stop you from moving, but it can stop the child from moving. There are many factors that are taken into consideration in relocation cases, so it's hard to get into specifics via email.

With regard to child support, the incomes of both parents are factored into the Child Support Guidelines, but you will get a credit off your income for each biological child you have living in your home.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
