Legal Question in Family Law in South Carolina
non custodial parent rights
what are my rights as a non-custodial parent when it comes to my sons education and medical issues? His Mother has gone to the school to try and stop me from visiting him and when the school could not get ahold of her when he was in trouble they called me and her boyfriend went to the school and berated the principal. Why does he have more rights then me?

Re: non custodial parent rights
The boyfriend has NO rights to your child, but the mother can designate someone else to make decisions if she is not there to do so. However, that is not to say that under those circumstances that his decision would trump yours. If you are concerned about this issue, then you might consider going back to Court to have this clarified if your current Order does not sufficiently address this situation.
