Legal Question in Family Law in South Carolina
Hi, obtaining a divorce as a plantiff, and the defendant does not want a divorce or does the person send the papers back, and have been seperated more than one year. Will the judge still grant the plantiff a divorce without the papers been mailed back or an response?
Thank you.

It is not necessary for the Defendant to file or do anything in response, provided he/she was properly served. If there was not proper service, then the case cannot go forward.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
