Parental custody

A friend battling cancer would like to ensure that her children are cared for in the event of her death, but her spouse/their father is an unfit parent. What rights does she have?

The mother can (and should) have a provision in her Will that specifies who she wants to have custody of the children. It does not guarantee that that person will get custody, but it certainly helps them if a custody battle arises later.
