Legal Question in Family Law in South Carolina
Paternity Test
My boyfriend has an ex who has an 11 month old son. She claims that her son is my boyfriend's. He and his family take care of the baby. The baby stays mainly with my boyfriends mother. Before I knew him, my boyfriend was in jail. He asked for a dna test done while h was in jail. She was pregnant then and could of had a dna test done for free, but she never did. Now, she admits to sleeping with two men at the same time and doesn't know really who the father is. We are pushing for a dna test to be done, but she is claiming that we will have to pay for it. Is that right? Even if it turns out that he is not the father?

Re: Paternity Test
In many cases, the Court requires the party requesting the paternity test to pay for it. However, if he turns out not to be the father, the Court can require the mother to reimburse the father for the cost of the DNA test.
It is important that you consult an experienced family law attorney to discuss the process in more detail. If you need more information, you can visit my family law blog (www.SCFamilyLaw.com) or our website (www.StevensFirm.com). I wish you the best of luck.
