Legal Question in Family Law in South Carolina

phone tapping

My spouse without my knowledge on two separate occasions has recorded my phone conversations. He is accusing me of adultry which is not true. I found the cassettes hidden at our home. Can he do this legally? If someone calls our home I don't know if they are being recorded or not. The phone is listed in both our names. Isn't this an invasion of my privacy and my childrens too. Their conversations are being recorded too.

Re: phone tapping

The state laws vary. I believe federal law prohibits taping a conversation unless one party to the conversation consents. Some states go further and prohibit taping unless everyone consents. Check with the local state or federal prosecutor or a private attorney to find out what your options are in your state.
