property settlement issues

I left my husband and also our home due to unlivable conditions for my daughter and myself. (some physical abuse,

aggressive launguage, fighting, tension) I am struggling to make it financially and want to try and get the divorce process going but he does not want to cooperate. I do not have $1500 to get a lawyer and divorce papers. How will my equity in the home be effected if I do not file for divorce? I had alot of inheritance money used to purchase the house and also worked during the marriage to help acquire our property. If I have to wait for a couple years before I can file, will my portion of equity be stopped as of the time I left, or will it continue to grow until the divorce. I believe that is why he is no cooperating - he is in our house and I am stuck in a rent situation. Because he is not working with me, I am getting no alimony, no compesation for the pension or retirement funds or anything. My only advantage is that I am coverage on his medical benefits. If I know that I am not at a disadvantage having to wait this out, I will feel better about the difficult circumstances.

(P.S. - I was married 8 years but my 12 yr old daughter is not his child so I realize I am not entitled to child support)

I realize the tough situation you are in. However, sometimes it really takes an attorney to protect your interests. Call around and find an attorney who doesn't charge for initial consultations.
