Legal Question in Family Law in South Carolina

Public Announcements

To whom it may concern,

I have been legaly sperated for nearly two years now. My husband, who I am not on speaking terms with anymore has told me several months ago that he filed for divorce. He said he gave his attorney my mailing address in Germany, which is now not current anymore since I relocated to the US. He has been assuring me that he filed but I have yet to receive paperwork of any kind. Is there such a thing as public divorce announcement, that's what he keeps telling me, for me to check the papers but I am nt in the state he filed in, how do I know rather I am divorced or not.

I feel very lost because I am not familiar with US laws such as divorces. Do attorneys send divorce paperwork overseas? Thank you very much in advance. I am very excited to hear from you.

Re: Public Announcements

If you resided in Germany at the time of filing, then he must divorce you in the county that either you and him last resided as husband and wife, or in the county that he resides. His attorney is required to try and serve the papers on you at your last known address. If that doesn't work, then the attorney must run a legal ad in a newspaper. I can't tell you which newspaper that would be without more information. If you want to check the status of your case, you can call the family court in the county where you two last resided together, and/or the county where your husband currently resides. You can also call your lawyer's attorney and give him/her your current mailing address. If you don't know who the attorney is, then ask your husband, whether you are on speaking terms or not. In any event, contacting the courts that I explained to you should do it. Good luck.

Re: Public Announcements

You may contact the Clerk of the Court in the county where your husband lives. The Clerk should be able to tell you whether or not a divorce action has been filed.

Under Florida law, it is possible to serve a spouse by mail. And, in Florida, under certain circumstances, one spouse may publish notice of the divorce action in a local newspaper. Service by publication is, in general, only used when the spouse to be served cannot be located after a reasonable search.

It is suggested that you contact an attorney who can review ALL of the facts of your case.
