How can i put my childrens father on child support?

I have been living with my boyfriend for four years, we are in the process of seperation. I tell him that i am going to put him on child support and he tells me that he will just have his father write a letter and lie about his income. My childrens father has a buisness and is not registered and he also doesnt have a social security number. I know he has a bank account but it is under his brothers name. So somebody please give me some advice on what i can do???

An action for child support should be initiated with the court. The court can grant you the right to investigate the father, including an investigation of his income. He may be able to hide income temporarily, but with investigation his income will be uncovered. Further, under some circumstances, the court will impute an income to him even if he proves he does not have income at the time. This means the court will base child support payments on an amount of income the father is capable of earning, even if he is not earning that amount at the time. This is sometimes done by the court when it can be shown that the father has worked in the past, is capable of working now, and when current income is not verified.
