Legal Question in Family Law in South Carolina
What Right does he have?
I have a concerning question. I'm from germany and live in texas since a year now with my 6 year old daughter and got married here. I haven't heard from the father of my daughter in 5 years and 2 month and haven't recieved any child support either. Now he is back in contact with us since a year now but still he is not paying. My daughter has the full german citizenship since she was born in germany and I have full custody of her. Since I'm not very familiar with the american law and he mentioned something about gettin a lawyer what rights does he have as a deadbead Dad? I invited him over for her birthday but he can't come because of his job, I invited him a second time for some other time but still he will see if he can't come, he wants to have her in his every day live and not just for a visit. Well it isn't possible. Can he get something to stop me leaving the country with her? we are both german full citizen

Re: What Right does he have?
A TX court could assume jurisdiction of this matter since the child has lived in TX for more than 6 months. The father could initiate a lawsuit for visitation and limit the child's return to Germany. That same lawsuit could seek to collect the child support and have it enforced as a judgment against him. While it is possible that he could prevent the child from returning to Germany, it is more likely that the parents would have to cooperate on periodic visitation from Germany.
