Legal Question in Family Law in South Carolina

Do i have to send my children

I have been divorced for 3years. In my divorce papers it states that neither party can have the opposite sex spend the night when the children are present. My ex is now wanting to move in with his girlfriend. Do i have to send my children or do they have to be married first.

Re: Do i have to send my children

If he has the girlfriend there overnight when the children are there, he is violating the Order. If you refuse to send the kids, you would be violating the Order as well.

Your best course of action is to remind him about the prohibition on having overnight guests of the opposite sex, and then to file a contempt action if he violates the Order.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
