Legal Question in Family Law in South Carolina

separation agreement violation

If my wife violates our separation agreement with a paramour and my 9 year old daughter sees it. Can she testify? Or do I need more proof than that?

Re: separation agreement violation

The Court will typically NOT allow a child to be called as a witness to testify against the other parent. You should contact a private investigator to get the proof that you need, which will help you keep your child out of the middle of a messy situation.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
