Separation
I have no money to start a legal divorce. My wife has agreed to my taking our 12yr old son as she would not be able to care for him. Getting her to sign a wrtiten paper staing her willingness to allow this..if I get it noterized, will this work in court down the road if needed?

Such a signed statement is better than nothing, but just barely. The problem you will have is that the written statement is not enforible if (or when) she changes her mind and wants the child back.
You should consider saving (or borrowing) the money to hire an attorney to handle the case for you. If you cannot do so, you might consider consulting Legal Aid to see if you will qualify for them to represent you at no cost.
