Legal Question in Family Law in South Carolina

Separation Paperwork?

My husband and I visited a lawyer at the beginning of our separation and he said that there was no paperwork that had to be filed. He said the we'd just need to petition for a divorce after our year was up. I keep reading about ''legal separations.'' Do we need paperwork??

Re: Separation Paperwork?

If you have any children, assets, debts, or other important issues, it is almost always better to have your agreement reduced to writing and approved by the Court so that it is legally enforceable. By doing nothing and waiting until the year passes, you are taking on some risk, which you may or may not want to do.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
