Legal Question in Family Law in South Carolina
Been seperated for about 3yrs & recently finalized divorce. We have a 3yr old daughter & we are using judge browns visitations. Im living with my girlfriend whom ex has known, met, & asked for help from when we were just friends & my ex & i were trying to work things out. My daughter has been around her for several years...she has also spent the night @ her house when i seperated & now ex has never said amything against it however now all of a sudden she is telling me my daughter cant stay overnight because thats what it says in guide lines nor did she bring it up in court during discussing visitation which is going to shorten my time with my daughter when im supposed to have her from 6p fri. to 6pm sun. also according yo the guide lines. My questipn is can she keep me from having my daughter overnight when it was never a problem before and she didnt bring it up in court.

If the Order prohibits that conduct, then you are subjecting yourself to possibly being held in contempt if you violate those terms. You can try to argue those items as a defense, but the terms of the Order will likely prevail.
These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
