Legal Question in Family Law in South Carolina

My husband and I have been married for 9 years, in which time we have 4 children, and I have not been able to work. We are thinking about seperating, and he refused to give me money for food for the week, like he usually does. We are still together at this point in time. Is there anything I can do. He locked me out of our checking account. What do I do?

I should also mention that he only comes home every other weekend, and I have to be here with the kids, and that is why I cant work.

It sounds as though you are caught in a difficult situation due to his actions. If you are ready to move toward separating or divorcing, then you should talk with an attorney to find out your options based on your specific facts.

If the bank account is listed in both names, then you have the right to withdraw some or all of the funds from that account whether he likes it or not. The Court may make you account later for how you spent those funds, but you have access to them nonetheless.

You don't have to stay under his control if you do not want to. The Court will make him pay child support to you if you have custody of the children, and that support will likely include daycare expenses to enable you to work.
