Seperation

I am not legally married but have been with the same person for over 8 years and are considered common law married. Do I still need to file for a divorce and how do I go about getting one done?

If you are common law married, then you will have to get a divorce just as if you had a "church wedding." All of the issues of your marriage will have to be addressed, as well as having the Court find that you are actually common law married.
