Legal Question in Family Law in South Carolina

Seperation/Divorce

My husband and i are seperating. i had heard that for the one year requirement in SC neither spouse is allowed to date each other or other people. is this true?

Do we have to file legal papers for the seperation to begin or can we just seperate?

Also, we want to do this with respect for each other and save money- can we use a mediator or do we need lawyers?

thank you!

Re: Seperation/Divorce

As long as you are married, you can commit adultery and suffer the consequences of doing so. This is true whether you are married and living together or married and living apart.

The one year requirement for divorce does not require a legal separation for one year, but simply living under separate roofs for that time period.

As far as attempting to minimize your legal expenses, the best thing that you and your husband can do is to try to be reasonable and agree upon as many issues as possible. When people act unreasonably or fight over more issues, it always costs more.

It is a good idea for you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
