Legal Question in Family Law in South Carolina
simple assault
In 2006 my daughter and I had an argument. I was taking care of her kids, one was sick,my daughter was to hard on my grand daughter. We pushed each other around, she called the cops,I was arrested. It never went to court. My new employer's wife who left him for another man is crazy,my employer has custody of the kids, she did a background check, found the simple assault charge that never went to court, made a big scene,I had to leave my job. What can I do,and what can my employer, her husband do to keep me as his nanny, since he is very happy with me, because I do take good care of his 4 kids.

Re: simple assault
If he has custody of the children, he will be able to choose their daycare provider. If he has visitation, he will be able to choose their babysitter during the times that they are with him.
Having an arrest on your record, by itself, should not disqualify you from being a childcare provider. If you wish, you can probably have the arrest expunged since it was never prosecuted. You can contact a criminal defense attorney in your area to discuss the expungement process.
