Single mother of small child

Single mother has always had custody of minor child. Father is not listed on birth certificate; he did not fight this issue. Child has mother's name. Father sees child at regular intervals with mother present. Father continually threatens to take mother to court. Father pays what he wants weekly for child support; mother has not taken father to court for child support and does not plan to. However, mother is tired of father's threats to go to court everytime he does not get his way. What are mother's/child's rights?

Why doesn't "mother" just take father to court, establish custody with mother, get a child support order, he will get a visitation order, and then there will be nothing left to threaten "mother" about?
