Legal Question in Family Law in South Carolina

My son is 13 years old and doesn't want to see his dad. We live in SC and dad lives in CA. Divorce was filed in CA. Does my son have to go if he doesn't want to and if he doesn't go does my ex have legal ability to take me back to court?

If the Order is violated (the child does not go for visitation), then the other parent can seek to have you held in contempt of Court. Most judges will not let a child dictate to the parents or to the Court what he will / won't do.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
