Legal Question in Family Law in South Carolina

south carolina divorce

I have a friend who says he is legally divorced from his wife in south carolina but they never divided all the property especially the house. He says his name is still on the house after nine years of a divorce and he is still fighting to get her to pay out for half the value of the house. I say he is not legally divorced because the property was not completely settled. He claims the laws are different in SC and he can get a divorce and settle property later as he claims he knows other guys that have done the same thing. By the way, we both live in north carolina and I have been divorced her in NC and I know it wasn't like that for me. Who is right? Is he really 100% divorced?

The Court can grant a divorce and reserve the other (financial) issues for later, but it is very, very rare that a Judge will do so. In fact, I know of no cases first hand in which that has happened, because it is rarely in anyone's best interest to handle things in that manner. It sounds to me like your friend is misinformed or misunderstands his situation.
