Is it legal in a divorce case to get the cell phone records of spouse if name is not on account?

Also does a spouse get 1/2 of other spouses 401K if divorcing.

In divorce cases, the attorneys can issue subpoenas to cell phone providers to obtain copies of any necessary records. With regard to the retirement accounts, the marital portion is included in the asset/debt distribution.
