unmarried custody

my daughter and her boyfriend live together but aren't married, but live together in ill. things are not going so good and she is thinking about moving back to s.c. can he file papers for custody where she can't bring the baby back here?

Generally, the "home state" of the child will have jurisdiction over custody issues, and that is determined by where the child has lived for the last six months.
