Legal Question in Family Law in South Carolina

Visitation in South Carolina

My boyfriend is in a very tight situation. He has a daughter by another woman and the mother will not let him see the little girl without preconditions which have lately included requests for sex. My boyfriend will not give in to her but still wants to see his child. Currently he is not working, but like any capable father is able to provide the love and support this child needs. If he decides to go to family court to request visitation, what conditions will the judge make to determine if he can have regular visitation?

Re: Visitation in South Carolina

The Court will generally allow both parents to see the child unless there are legitimate reasons not to do so. If he wants to see his child (and to not have to comply with her requests/demands), then his best option is to file an action in Family Court to have the issues addressed there. He may also want to obtain proof of her unreasonable demands so that he can use those in that case.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
