Legal Question in Family Law in South Carolina

My wife and I have been married for 17 years this Mar. This past ct. she announced that she no onger wants to be married. The week before Thanksgiving, she left the house and has been staying with another man. We have had our home for about 16 years and she has always made the house payment from her check as well as her car payment and groceries. I have paid all utilities, insurance, cell phone, satalite TV, and my car payment from my check. She keeps telling me I have to move out so she can move back in with her boyfriend. What are my options? I have no plans of leaving unless I am just screwed. I can prove she lives with him and I have his name. Any advice would be appreciated.

Thank you,

James

You do not have to leave the house, and it is unlikely under the brief facts that you listed, that the Court would force you to move out so that she and her boyfriend can move in. If she is committing adultery, then you should consider getting a private investigator to prove it and then file a divorce against her on that basis.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
