Legal Question in Family Law in South Carolina

help me win this war

my mom has raised my newphen since he was a baby she recently died, my newphew is now 15 yrs old and his father my brother wants to come get him and raise him. my newphew does not want to go. i live in the home and has always helped my mom raise him. i really need to know what i can do he does not want to go. he was reared in the home. help

Persons who are not biological parents are all in a similar situation with regard to obtaining custody of children. Biological parents have an elevated status when it comes to fighting for custody of their own children.

If you can show that you have acted as a parent to the child in the past, you may be able to seek rights as a "psychological parent" to the child, which might give you an advantage over the others.

The bottom line is that if you believe the child will be better off with you, then you need to consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
