Legal Question in Family Law in South Carolina

If a woman and man signed over custody rights to the man's parents and now the woman and her parents want custody of the child, can they take the child or do they have to prove the grandparents unfit. The grandparents have had custody of the child for 3 yrs now. The mother says that since shes the mother the court will give the child back to her. Can she do this?

There are many many more factors that must be known to even begin to answer that question. Custody cases are very complex, particularly when involving non-parents, so it's not possible to get into them in this forum.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
