Legal Question in Family Law in South Carolina

I am a youth minister. In my youth group is a 16 year old girl whose father is dead and her mother has had her parental rights revoked and lives in New York state. The girl was given to father's friends in SC to raise. This is who she currently resides. The situation there is horrible. It is an abusive (verbally and emotionally) environment. She has asked to come live with me until she finishes high school. If she leaves home could I be prosecuted for giving her a place to stay until the legal documents are recorded? What step should I take to become her legal guardian? My husband and I are both currently being approved to become foster parents through DSS apart from this situation. Thank you for your time.

You may want to consider filing for custody with the court. If there are emergency circumstances and a child is in danger of neglect and/or abuse, a request for emergency relief from the court may be filed. If the court grants the emergency relief, the hearing may be held in just a few days.
