Legal Question in Civil Litigation in South Carolina

bought register dog-seller will not send paperwork

I want to seek legal action against dog seller for selling me a registered english bulldog puppy with promised no show paperwork.

I am in the military and brought this dog online from website list bulldog babies.com.

I paid $2,946.42 in 1/1/05, payment was paid in full to dog seller - After paying for my dog by way of paypal payments I had the dog sent to my parents home address. Zelda the English bulldog was shipped to New York state in Feb 2005, the dog did arrive as planned- but without paperwork (puppy papers).

My mother immediately contacted the dog seller. The seller said that the dogs paperwork would be sent to my parents home address in March 2005.

For the past year +plus this seller has emailed many lame excuses why no paperwork has come. I have saved all emails. The newest excuse is a request for additional $ 90.00 before seller will release the paperwork.. Can I take legal action on this person- they live in SC (I have to make my mom power of attnory due to I am headed back to Iraq soon--my mom lives in NYS). Any help or advice would be welcome

I also want to stop this seller from taking advanage of other dog buyers-if possible.

Re: bought register dog-seller will not send paperwork

Because delivery was made in upstate NY, you may sue in the local court in your mother's home town. DO NOT use 'small claims court'.

Your case is extremely strong if the judge can be educated as to the difference in value between mutt and pedigree. This loss in value is the toughest part of the case.

Giving your mother POA is a sound course of action.

In deference to your service to me and my country in Iraq, please let your mother know that I am available for further consultation for no fee.

I am sorry you were burned by a sleazy 'puppy farm' person. They are generally unscrupulous and unreliable people.
