Breach of Contract

I am a Private Investigator in SC, USA. I have a client that is suing for breach of contract. We did not provide client with a report or invoice on time. However, I have a witness that the client did verbally authorize a weeks extension and our package was delivered on time at that point. We have tried to offer a settlement twice. Once for $1000.00, which was refused and a second for $2000.00 which was a refund of his retainer, which was refused too. So now we are going to court. Do you think that since I have a witness, a police officer that witnessed the verbal extension, I have a chance of winning the case?

I hate advising people unless I have seen the Complaint, the answer and all of the evidence. I can tell you that given the amount of money involved, I assume that this case is in Magistrates Court. That court is somewhat more relaxed than Common Pleas Court. You will have an opportunity to defend the suit and tell the court everything you can. The court will decide based on the evidence. You seem to speak clearly and your able to communicate and that will certainly help. The best thing you can do is consult with an attorney who can look at everything and ask questions. I know its hard to pay an attorney when the law suit doesn't justify the expense. But its still the best thing to do. I wish you well.
