Legal Question in Civil Litigation in South Carolina

Car Accident

My daughter in law had an accident 2 years ago. It was rulled the other drivers fault. The other persons insurance refused to pay based on what the driver said. My daugher in laws car was totaled and she broke her shoulder. They got a lawyer and finnally settled out of court. They both agreed on an amount and were told they should have there money in about 4 to 6 weeks. Now she is telling us that they may not get the money. The other party is appealing. Is this possible? If the aggreement was made do they have the right to go back on the aggreement?

Its a little hard to tell exactly what has happened here. You said they settled out of court. But then you said the other person is appealing. I don't understand that. Generally speaking, you appeal a court verdict or judgment. You don't appeal an out of court settlement. You also didn't say if the agreement was in writing or not. That would make a difference.
